Want Wisconsin MA Watch Your Assets

Let the reclamation begin.  The Wisconsin Budget Committee voted 10 to 6 to define a standardized approach to recovering assets from estates of former MA (Medicaid) recipients.  This is another way of saying the medical assistance benefit is becoming tighter.

Wisconsin is defining all property as marital property at the death of the community spouse.  This gives the State of Wisconsin the means to lay claim to all property the couple owned up to five years before the MA application was filed.

The State of Wisconsin wants to claim the property at the death of the second (community spouse) spouse to pay back the Medicaid received by the institutionalized spouse.  The inclusion involves all property owned by either spouse in a marriage at the time of the MA (Medicaid) application.

Estate planners suspect this may change the way individuals form contracts (marriage) to couple.   Retaining visible assets in a family home where a parent has a disabling medical illness just got a bit tougher in the State of Wisconsin.   Home Care Path encourages readers to watch this issue as it unfolds in the next few months.
