Debt Collection Offices Interested in Wisconsin Health Insurance Exchange

Debt collection offices have been interested in the Wisconsin Health Insurance Exchange Marketplace because of the phrase "reasonable efforts".   In compliance with the Internal Revenue Service 501 (r) non-profit hospital's must make reasonable efforts to see if a patient is eligible for financial assistance before processing a debt through a collection agency.

The non-profit hospital can still sue a patient for an amount owed, but only after thoroughly demonstrating the patient is not eligible for financial assistance.  The hospital must provide for the patient 120 days, along with the forms and help if needed to procure available funds for the medical bill. 

The claims department will be asked to demonstrate how all reasonable efforts have been taken to ensure the individual did not qualify for financial assistance prior to the hospital employing a collection agency.  So, simply posting a notice in the waiting room would not be sufficient under this regulation.
