Judge Christina Reiss To Halt Fraudulent Use Of Medicare Statute

The Medicare Medicaid certified health provider (registered nurse, physical therapist, occupational therapist, speech therapist) will no longer be able to deny you service because of "no documented progress, plateaued,  or a chronic progressive disease process resulting in maintenance".  This frequently verbalized improvement standard is a mis-representation of existing Medicare Medicaid statute, fraudulent.

The improvement standard announced the provision of health services to individuals who were not getting better was not in line with the true intention of the Medicare Medicaid program.  This class action suit announces the need for additonal health services does not depend on the individuals ability to demonstrate progress as defined through recorded participation in implemented models of therapeutic design.

In January 2011 the Center For Medicare Advocacy and Co-Counsel from Vermont Legal Aid filed a class action lawsuit against Kathleen Sebelius Secretary of DHHS (Department of Health and Human Services).   The class action suit alleged administration facilitated the denial of care through use of an improvement standard that requires progression to assure access to needed health services.

This inappropriate practise prevented individuals with chronic progressive disease processes to benefit from health services that could slow or stall the loss of fitness and function.  Timely access to these much needed services could prevent hospitalizations and save the Medicare Medicaid programs money. 

Federal Chief Judge Christina Reiss Of The United States District Court In Vermont will deliver the ruling.  An important piece of the proposed settlement is the addition of a printed mandate to the Medicare Policy Manual that coverage of therapies does not turn on the presence or absence of a beneficiary's potential for improvement from therapy, but rather on the beneficiary's need for skilled care.

Investigating The Out Break Of Fungal Meningitis

Meningitis is an inflammation of the membranes that cover the brain and spinal cord.  The initial symptoms are dizziness, nausea, elevated body temperature, and head pain. 

The Centers For Disease Control (CDC) is currently investigating an out break of fungal meningitis.  Individuals became infected with fungal meningitis through medication (injectable steroids) injected in to the body to relieve pain. 

Approximately fifty vials of  steroid medication has tested positive for fungus.  Two fungus types have been connected to infected patients.  The Aspergillus a fungus more commonly found.  And Exserohilum a black mold fungus.  This leaves the CDC to question the accuracy of the diagnostic testing. 

The CDC has encouraged providers to treat a patient who is known to have received an effected steroid injection with the antifungal medications even if the person's diagnostic test shows no fungal significance.  A precautionary practice.

The CDC identified the New England Compounding Center as the source of the steroid contaminated with fungus.  In cooperation with a Food and Drug Administration (FDA) investigation the New England Compounding Center coordinated a voluntary nation wide recall of all products from the Framingham Massachusetts Distribution Center.

Health planners are reviewing regulations that govern activity of a compounding pharmacy verses larger scale drug manufacturing.  Specifically has the regulatory capacity at the state level evolved to attend to the market changes.

Tax Loss Harvesting

Tax Loss Harvesting is a strategy to manage individual investor loss with a market down turn. When a senior sells shares of a stock or mutual fund for less than was originally paid a capital loss is created. This capital loss calculation can then be subtracted from any capital gain generated from selling shares of a stock or mutual fund for more than the original purchase price.  The loss has now offset the gain and reduced the investors tax burden. 

When a net capital loss is greater than your capital gain the balance (up to 3 thousand dollars per year) can be subtracted from your taxable income.  Remaining capital loss beyond the 3 thousand dollar limit can be brought forward and subtracted from the following year. 

The shares of stock or mutual fund must have been owned for greater than 30 days and after a sale could not be re- bought within 30 days to maintain eligibility.  Individuals can monitor their investments throughout the year for drops in value.  Please be sure and consult with your independent investment advisor when managing your funds.

Facebook Passes One Billion Users

Facebook is one of the most powerful social communication enterprises in the world.  Since the  (IPO) Initial Public Offering in May 2012 Home Care Path www.homecarepath.com has predicted great things for facebook.  The founder Mark Zuckerberg has cleverly facilitated a level of user autonomy that has resulted in huge participation.

NUAN plus TRCR equals More Market Density Per Service Area

Nuance Communications (NUAN) in April 2012 purchased Transcend Services Incorporated (TRCR) which enhanced the market density in their defined service areas.  Metropolitan, Community, and Rural hospitals reside on the combined customer list.

Nuance Communications (NUAN) delivers voice enabled clinical documentation.  Transcend Services Incorporated (TRCR) delivers medical transcription and speech editing services.  The two combine their expertise to serve more hospital providers with an accelerated documentation process.

NUAN and TRCR create a service designed to improve the way collected information can be accepted, processed, and utilized.  Systems to convert provider dictation in to an easily accessed storage of electronic data.

Conversion from voice to record includes clinical language enhancements produced with (ICD-10) medical classifications developed by (WHO) the world health organization.  This creates hard documentation from provider recitation that can be used in a more meaningful way.
