The State of Wisconsin has just joined 5 other States in a lawsuit against (ACA) The Affordable Care Act. The argument of the lawsuit has to do with unclear language.
Because of unclear language:
- these States have to contribute to fees to cover Federal subsidies
- this provider fee is viewed as an unfunded mandate
- contracted participants (State of Wisconsin) were notified by a private entity appointed as administrator
The States now realize regulatory defined contractual processes facilitated implementation of a service the participants did not understand - unclear language.
An example to help clear this up would be Wisconsin's transition to Family Care IRIS 2.0 and the unclear transportation need.
Because of unclear language:
- contracted providers will have to cover transportation
- the transportation expectation is viewed as an unfunded mandate
- contracted providers will be notified by private (Integrated Health Agency) entity appointed as administrator
The providers will come to realize regulatory defined contractual processes facilitated implementation of a service participants do not understand - unclear language
The Wisconsin Family Care IRIS 2.0 dilemma

These two similar arguments are a common theme in facilitation of contracted services for large areas. Wisconsin can anticipate very similar activity when the need for transportation with the delivery of Family Care IRIS 2.0 benefit becomes more visible.
