Wisconsin municipalities have been operating on a guideline that property owners must allow registered inspectors in the buildings before they can challenge a tax assessment value. Under todays Federal and State Administrative position this guideline has been identified as an unreasonable search and goes directly against the 4th Amendment.
The Wisconsin State Supreme Court explained that the act of entering the buildings to assess property tax values is not such a special need that the 4th Amendment should not apply. Assessors can use other means to gather information about the property that results in an accurate tax valuation.
This indicates municipalities must still equally process a property owners challenge to the listed tax assessment value without an interior inspection. Federal and State Administrative leaders are more in tune with the importance of private property rights.
Faced with the requirement to secure a search warrant to enter buildings on private property the State registered inspectors will need to alter the service they deliver. The act of inspecting property is regulated in the State of Wisconsin. A property inspector must have taken classes and be listed on the registry to perform inspections for a municipality.
Wisconsin families visited by municipal employees who communicate messages on the perceived condition of their private property should immediately ask for the employees number which is listed on the Wisconsin Registry. Without a current Registry number the employee is not capable of performing property inspections.
